These Terms of Use (“Terms”) apply to the Match My Project website, forms, and services (the “Service”), operated by Inspired Design LLC (“Match My Project,” “we,” “us”). Please read them carefully. Our Privacy Policy explains how we handle your personal information.
1. Agreeing to these Terms
By using the Service or submitting a request, you agree to these Terms. If you do not agree, please do not use the Service. You must be at least 18 years old and either own the property where the work will be done or be authorized by the owner to request work for it.
2. What we do, and what we don’t
Match My Project is a free referral service for homeowners. We collect information about your home improvement project and refer you to independent contractors who do that type of work in your area.
We are not a contractor. We do not perform, bid on, price, negotiate, sell, contract for, supervise, or guarantee any work. Any estimate, price, contract, or warranty comes from the contractor, and any agreement for work is solely between you and that contractor.
The Service is free for homeowners. Contractors pay us a fee to receive project requests. That fee does not depend on whether you hire them.
3. How matching works
- You tell us about your project through our website or an ad form.
- We may call or text you to confirm that you still want a contractor to contact you and that we have the right details.
- We send your request to one contractor, or to up to three contractors if you chose to compare prices.
- The contractor or contractors contact you directly to discuss the job and schedule an estimate.
We cannot promise that a contractor will be available, contact you, respond within a certain time, or offer a particular price. You are never obligated to hire anyone.
4. About the contractors in our network
Contractors are independently owned businesses. They are not our employees, agents, or partners, and we do not control how they do their work. Before a contractor joins our network, we check that they hold an active license with the California Contractors State License Board (CSLB). License status can change, and we do not verify insurance, bonding, workers’ compensation coverage, or the quality of any contractor’s work. A referral is not an endorsement or guarantee.
5. Before you hire
You are responsible for choosing a contractor. We recommend that you:
- Check the contractor’s license, and any complaints, at cslb.ca.gov or by calling 800-321-2752.
- Ask for proof of insurance and workers’ compensation coverage, and for references.
- Get more than one estimate for larger projects.
- Get a written contract before work begins. California law generally limits the down payment on a home improvement contract to $1,000 or 10% of the contract price, whichever is less, and gives you a right to cancel certain contracts within three business days.
6. Calls and text messages
Our request form has two separate consent boxes.
Contact about your project (needed to be matched). By checking this box, you agree that Match My Project and the contractor or contractors matched to your request (one, or up to three if you chose to compare prices) may contact you about your project at the phone number and email you provided, including by calls and text messages made with automated technology or a prerecorded or artificial voice, even if your number is on a Do Not Call list. Consent is not required to buy any goods or services.
Text updates from Match My Project (optional). If you check this box, we may text you about your request. You can use the Service without agreeing to texts from us.
- Program: Match My Project request updates, such as confirming details and scheduling.
- Frequency: varies based on your request.
- Cost: message and data rates may apply.
- Opt out: reply STOP to any text from us. You can also revoke consent by any reasonable means, including by emailing support@matchmyproject.net. To stop calls or texts from a contractor, tell that contractor directly.
- Help: reply HELP or email support@matchmyproject.net.
- Mobile carriers are not liable for delayed or undelivered messages.
Our Privacy Policy explains how we handle text-message information.
7. Call recording
Calls with Match My Project may be recorded or monitored for quality, training, and compliance. California law requires the consent of everyone on a call before it is recorded, so we will tell you at the start of any call that is recorded. If you stay on the call after that notice, you consent to the recording. If you don’t want the call recorded, tell us and we will stop recording or end the call and help you another way.
8. Electronic communications
You agree that we may send notices and records to you electronically, by email, text, or on our website, and that electronic consents, such as checking a box on our form, have the same effect as a signature under the federal E-SIGN Act and the California Uniform Electronic Transactions Act. You can ask for a paper copy by emailing support@matchmyproject.net.
9. Your responsibilities
You agree to give accurate, current information, to submit requests only for yourself or a property you are authorized to represent, and to enter only a phone number that you own or are authorized to use. You agree not to:
- submit false, duplicate, or test requests, or requests on someone else’s behalf without permission;
- use the Service to advertise, solicit, or collect information about others;
- scrape, copy, or interfere with the Service, or try to access it by automated means; or
- use the Service for anything unlawful.
10. Our content
The Service, including its text, design, logos, and images, belongs to us or our licensors and is protected by law. You may use it only to request a referral for your own project. Some images on the site are illustrative and do not show work by any specific contractor.
11. Third-party services
The Service relies on and links to services we don’t control, such as contractors’ own websites, the CSLB website, mapping, analytics, advertising, phone, and text-message providers. We are not responsible for their content, terms, or privacy practices.
12. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not responsible for the acts, omissions, estimates, work, products, or conduct of any contractor or other third party, or for any agreement between you and a contractor.
13. Limits on our liability
To the fullest extent the law allows, Match My Project will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any damages arising from a contractor’s work or conduct. Because the Service is free for homeowners, our total liability to you for any claim related to the Service will not exceed $100. These limits do not apply to liability that cannot be limited by law, such as for fraud or willful misconduct.
You agree to indemnify Match My Project against claims arising from your misuse of the Service or your violation of these Terms.
14. Ending access
You can stop using the Service at any time. We may suspend or end access to the Service for anyone who misuses it or violates these Terms. Sections that by their nature should continue, such as disclaimers, limits on liability, and arbitration, continue after access ends.
15. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Subject to the arbitration section below, any dispute will be brought in the state or federal courts located in Los Angeles County, California.
16. Arbitration and class action waiver
Try to resolve it with us first. Before starting any claim, email support@matchmyproject.net with a description of the problem and what you’re asking for. We will try in good faith to resolve it within 30 days.
Individual arbitration. If we can’t resolve it, any dispute arising from these Terms or the Service will be resolved by binding individual arbitration administered by JAMS under its consumer arbitration rules, in Los Angeles County or by video, unless you and we agree otherwise. Either party may instead bring an eligible claim in small claims court, and either party may ask a court for an injunction to protect intellectual property or confidential information.
You and Match My Project each waive the right to a jury trial and to bring or join any class, collective, or representative action. Claims may be brought only on an individual basis.
Your right to opt out. You can opt out of this arbitration section by emailing support@matchmyproject.net within 30 days after you first agree to these Terms, with your full name, mailing address, and a clear statement that you are opting out of arbitration. Opting out does not affect any other part of these Terms.
17. Other terms
Contractors. Contractors who receive referrals from us are also bound by a separate contractor agreement.
Changes. We may update these Terms. We will post the new version here and update the date above, and we will give additional notice of material changes. Your continued use of the Service after a change means you accept the updated Terms.
Other. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver. You may not transfer these Terms; we may transfer them as part of a merger or sale of our business. These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
